LHDN Malaysia oversees the income tax administration for employers. This involves navigating a strict calendar of monthly deductions, annual reporting, and AIS e-filing submissions. This guide breaks down everything you need to know, from registration to 2026 compliance updates.
LHDN Malaysia (Lembaga Hasil Dalam Negeri) is the government agency responsible for collecting direct taxes and for governing employer income tax reporting in Malaysia.
Understanding the differences between individual reporting and corporate declaration is key for a smooth tax filing season.
| Document | Purpose | Employer’s Responsibility |
|---|---|---|
| Form EA | An individual statement of remuneration. It lists an employee's total earnings, benefits, and tax deductions (PCB) for the year. | Issue to Employees: Must be provided to staff so they can complete their own e-filing. |
| Form E | The employer’s annual declaration. It summarizes the total number of employees and the company's overall tax compliance status. | Submit to LHDN: For your company's payroll, submitted via the MyTax portal. |
| CP8D | It contains the granular financial details of every single employee in your organization. | Attach to Form E: Without a successful CP8D upload, your Form E submission is considered incomplete. |
📌 NOTE: The figures on your CP8D must match the sum of all issued EA forms accurately. Any discrepancies would most likely trigger LHDN audits.
LHDN has transitioned to mandatory online submissions for most notifications. To help you stay on track, here are the tax form requirements, filing deadlines, and submission methods.
| Form | Purpose | Deadline | Submission Method |
|---|---|---|---|
| Form CP22 | New Hire: Notifying LHDN of a new employee. | Within 30 days of their start date. | Mandatory Online: via the e-CP22 application on the MyTax Portal. |
| Form CP22A | Cessation (Private Sector): Resignation, retirement, or death. | 30 days before cessation OR within 30 days of death notification. | Online via e-SPC: For original filings and amendments. Manual submissions are only allowed for cancellations. |
| Form CP22B | Cessation (Public Sector): Resignation, retirement, or death. | ||
| Form CP21 | Leaving Malaysia: For employees departing the country for >3 months. | At least 30 days before the expected departure date. |
If an employee resigns, retires, or leaves the country for more than 3 months, you must notify LHDN and withhold any monies payable for 90 days or until a tax clearance letter is received.
Compliance is a year-round commitment. Beyond the monthly PCB (Potongan Cukai Bulanan) deductions, employers act as the bridge between the government and the workforce.
Every company must obtain an employer's tax number (E-number) from the MyTax portal via e-Daftar during the LHDN Malaysia registration.
Calculate PCB/MTD from employee’s remuneration and submit via Form CP39 on or before the 15th day of the subsequent month.

Submit the Return Form of Employer (Form E) together with the CP8D by 31 March. This must be done via LHDN e-Filing.
📌 NOTE: Employers who have submitted information via e-Data Praisi need not to complete and furnish CP8D via Form E.
Provide employees with their Statement of Remuneration (Form EA) by the last day of February of the following year to facilitate their own income tax e-filing Malaysia.

Even small oversights can lead to heavy penalties, employee dissatisfaction, and potential audits. Here are some of the most frequent tax compliance pitfalls in Malaysia and how to avoid them:
Monthly Tax Deductions (PCB) must be remitted to LHDN no later than the 15th day of the following month.
Failing to meet this deadline can result in fines ranging from RM200 to RM20,000, imprisonment for up to six months, or both.
✅️ Smart HR Tip: If the 15th falls on a weekend or public holiday, the deadline is generally the last working day before it. Don't wait until the final hour. Automate your bank file uploads by the 10th to avoid processing delays.
Form EA is the backbone of your employees' personal income tax e-filing Malaysia. Common errors include omitting Benefits-In-Kind (BIK) (e.g., company cars or mobile phones) and failing to report tax-exempt allowances like for childcare or parking.
Incorrect data forces employees to misdeclare their income, which triggers LHDN audits for both the individual and the company. Inaccurate reporting can also lead to a fine of up to RM20,000.
✅️ Smart HR Tip: Reconcile your payroll records with your Form E and CP8D at year-end. If you find a mistake after issuing the form, use the e-Data Praisi on LHDN MyTax portal to submit amendments immediately.
LHDN no longer accepts manual submissions for Form CP22 (New Hire Notification).
Submitting paper forms is now considered "non-submission." Failure to notify LHDN of a new employee within 30 days is an offense carrying a fine of RM200 to RM20,000.
✅️ Smart HR Tip: Transition to an automated onboarding process to easily generate and fill-up the necessary forms. All CP22 notifications must be made via the e-CP22 application on the LHDN MyTax Portal.
Managing payroll and tax compliance manually is a risk most businesses can't afford. Especially with LHDN’s move toward fully digitalized tax administration, employers need a system that does more than just calculate numbers, they need an audit-ready partner.
